The following provisions establish the general conditions of sale of the products offered for sale on the site www.ilios-sandals.com.com (hereinafter referred to as "the Site") by:

The purpose of these General Terms and Conditions of Sale is to define the terms and conditions of distance selling between the Vendor, on the one hand, and any individual who is not a merchant and who is of age or a minor, with the prior agreement of his or her legal representative only, (hereinafter the "Customer"), making a purchase on the Site, on the other hand.
These General Terms and Conditions of Sale, which are drafted in the French language, specify, in particular, the various steps necessary for the Customer to place an order, the terms of payment and delivery, as well as the follow-up of the Customer's order.
The Products offered for sale by the Seller are those listed on the Site on the day of its consultation by the Customer (hereinafter "the Products").
The Products are presented by means of an information sheet (product name, composition and price) drawn up with maximum accuracy and precision in order to allow for the most accurate and complete description. However, given the digital presentation of the Products on the Internet, it is possible that the Customer's perception of the photographic representation of the Products does not correspond exactly to the Product itself.
The Seller reserves the right at any time to add new Products, to delete all or part of the Products presented for sale on the site, or to modify their presentation, without any particular formalities with regard to Internet users.
The Seller undertakes to deliver Products that comply with the regulations in force relating to the safety and health of persons in accordance with European provisions, and in particular with the legislation on chemical substances with regulated content.
The prices of the Products are those appearing on the Site on the day of its consultation by the Customer.
The prices of the Products are indicated in euros and are inclusive of all taxes, including delivery costs, except for Chronopost Express delivery (D+1) - additional charge of 5 euros
The amount of the additional delivery costs is indicated to the Customer when placing the order.
The Products remain the property of the Seller until the price has been fully paid by the Seller.
Any order implies acceptance of the prices and description of the Products available for sale. The Seller undertakes to honour the orders received on the Site only within the limits of the available stocks of Products. If one or more products ordered are not available, the Seller undertakes to inform the Customer by e-mail as soon as possible. The Customer's order for an unavailable product will then be automatically cancelled.
Furthermore, the Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order or who presents any form of risk whatsoever.
The placing of an order by the Customer implies his or her full and unreserved adherence to these general terms and conditions of sale, to the exclusion of all other general terms and conditions of sale.
4.1 Placing an order
In order to place an order on the Site, the Customer must follow the following steps:
The customer can create his customer account or indicate his login and password associated with the connection on the site or after having validated his basket.
Step 1. Add the selected Product(s) to the shopping cart, with access to the cart being possible at any time for modification or validation;
Step 2. Validate your basket after checking its contents.
Step 3. On the order summary page, expressly accept the general terms and conditions of sale of the Site in force;
Step 4. Finally, the Customer will be redirected to the secure online payment site to validate the payment.
The Customer's final acceptance is materialised by the validation of his/her banking information (bank card number, expiry date and cryptogram).
4.2 Order confirmation
Following the placing of the order, the Seller will send an e-mail confirming:
- the registration of the order;
- the details of the items ordered;
Thereafter, the Seller will automatically send an e-mail informing the Customer of the dispatch of the order and the expected delivery times by the Post Office or the Seller's carrier (the times will vary according to the carrier chosen).
4.3 Modification or Cancellation of the order
As long as the order is not validated at the level of payment, the Customer may proceed with modifications and change his/her basket, he/she may thus modify a quantity; delete an article or simply continue his/her purchases. To do this, they simply click on "My basket" and make the desired changes.
On the other hand, once the payment has been validated, the transaction is recorded and there is no recourse to modify or cancel it online. The Customer must wait to receive the product(s) before carrying out the return procedure after delivery of the parcel (within seven days of receipt), in order to obtain a refund from the Seller.
4.4 Order archiving
The Customer's shopping basket is archived and kept for a period of 7 days for future orders.
However, in order to access their archived basket, the Customer must reconnect to the Site using the same computer with the same IP address for connection to the service.
The details of the order, whatever its amount, are archived in accordance with Article L.213-1 of the Consumer Code, for a period of ten years on a secure server. However, no credit card number is kept.
The Customer accepts that the order confirmation is considered as proof of the contractual relations between the Parties.
5.1 Payment by credit card
Payment is made online by credit card when the Customer places the order. The following cards are accepted: Carte Bleue, Visa, Mastercard, issued in France.
The bank account corresponding to the bank card used for payment will be debited on the day the order is dispatched.
The Seller reserves the right to cancel an order which, during checks of bank details, presents a risk of fraudulent use of a bank card, or in the event of refusal of authorisation of payment by banking organisations.
In addition, the Seller reserves the right to refuse to honour an order from a consumer who has not paid in full or in part for a previous order or with whom a payment dispute is in progress.
5.2 Payment by PAYPAL
The Seller has also adopted the PayPal payment system, which allows account holders to make purchases on the Site by this means.
This solution makes it possible to limit the information that the Customer communicates to the Seller and guarantees the conformity and security of each transaction.

5.3 Payment security
All purchases made on the Site are protected and secured 7 days a week and 24 hours a day.
By clicking on the credit card payment, the Customer is directed to the secure payment site PayZen which integrates the SSL security standard. During the payment process, the Customer indicates his/her card number, the date of validity and the cryptogram on the back of his/her bank card. These data are automatically transmitted in encrypted mode (SSL protocol) to be verified in order to avoid abuse and fraud.
The encrypted bank details disappear automatically after full payment, except in the case where the Customer has explicitly confirmed that they are kept on the PayZen payment site with a view to a future purchase on the site.
By clicking on payment via PayPal, the Customer's financial information is never communicated to the Seller. PayPal encrypts and protects the Customer's card number once and for all. The Customer pays online by simply entering his email address and password.
The Seller reserves the right to verify the personal data provided by the Customer and to apply the measures deemed necessary (request for proof or cancellation of the order) in order to avoid any fraudulent use of credit card numbers.
6.1 Place of delivery
The Seller delivers orders only in Metropolitan France.

CHRONOPOST EXPRESS: Additional fee of 5 euros
Home delivery - the parcel is delivered to the Customer personally or delivered to the Customer's letterbox. If the size of the parcel does not allow it to be delivered to a letterbox, it is made available to the Customer in the post office to which the Customer is attached. The Customer has 10 working days from the arrival of the parcel at the post office to collect it. After this period, the package will be returned to the sender. In all cases, the Customer will be informed by e-mail 24 hours before the delivery of the parcel.
The Seller declines all responsibility for delays in delivery caused by the absence of the recipient of the parcel or his failure to collect it within the time limit set for this purpose.
SO COLISSIMO (RELAIS COLISSIMO)
Delivery in one of the 10,000 post offices of your choice in France (without prior visit by your postman at home).
The Client will be informed of the availability of his parcel by SMS and by e-mail, with a collection voucher allowing him to collect it from the office within 10 working days.
After this period, the parcel will be returned to the sender.
Delivery in one of the 7500 Colissimo relay points of the Customer's choice - close to the Customer's home, place of work or holiday destination.
When the relay point initially chosen is unable to take charge of the parcel (saturation, exceptional closure, etc.), the parcel will be dropped off at the nearest available relay point to the relay point initially chosen. The Customer will be informed of the availability of his parcel by SMS and email, with a collection voucher allowing him to collect it within 10 working days.
After this period, the parcel will be returned to the sender.
Delivery in one of the 500 automatic collection lockers - with a wide range of hours and available on the daily route. The Customer will be informed of the availability of his parcel by mail and SMS with a code allowing him to collect it within 3 working days.
After this period, the parcel will be returned to the sender.
6.2 Delivery costs
Express chronopost delivery is invoiced at 5 € including VAT. This rate applies per order and up to 3 items. Beyond that, an additional charge of €5 including tax will be applied for each additional item purchased.
The word "item" includes "shoes"
6.3 Delivery times
The Seller processes orders within an average of forty-eight hours (48h). However, at certain times (in particular during sales or promotional operations of any kind), the processing time may be longer due to the greater number of orders to be processed.
In all cases, the Customer automatically receives an email informing him/her of the shipment, as well as of the follow-up of his/her order, and the Seller undertakes to deliver the goods ordered on the Site within the time limit, expressed in working days, which will be displayed in the order summary as well as in the order confirmation email.
Nevertheless, it is understood that the delivery time starts from the receipt of the Customer's payment and includes the time required for the processing of the orders by the Seller's services as well as the transport times used by the Post Office or the Seller's carrier. The delivery time therefore varies according to the delivery method chosen.
In the event that the delivery deadline is exceeded due to the Seller, and not justified by a case of force majeure (see article 11 of these general conditions of sale), the Customer may, in accordance with article L.216-2 of the Consumer Code, proceed to cancel the sale by registered letter with acknowledgement of receipt or by a written document on another durable medium, if, after having enjoined the Seller, in the same way, to make the delivery within a reasonable additional period, the Seller has not complied within this period. Within fourteen days of receipt of this registered letter, the sums paid by the Customer shall be refunded in full.
7.1 Return policy
Subject to compliance with the provisions of articles 7.5 and 7.6 below, the Customer may return items within fourteen days of receiving the order to the following address

– en renvoyant le ou les article(s) concerné(s) en usant de son délai de rétractation selon les modalités de l’article 7.3 ci-dessous, étant précisé que les frais de retour restent à sa charge.
7.2 Garanties légales de conformité des Produits et des vices cachés
En cas de Produits livrés défectueux ou non conformes, le Client bénéficie des garanties légales prévues par la législation en vigueur : les garanties légales de conformité (articles L.217-4 à L.217-14 du Code de la consommation) et la garantie des vices cachés (articles 1641 à 1649 du Code civil).

Le vendeur livre un bien conforme au contrat et répond des défauts de conformité existant lors de la délivrance. Il répond également des défauts de conformité résultant de l’emballage, des instructions de montage ou de l’installation lorsque celle-ci a été mise à sa charge par le contrat ou a été réalisée sous sa responsabilité.»
«Article L.217-5 du Code de la consommation :
Le bien est conforme au contrat :
1° S’il est propre à l’usage habituellement attendu d’un bien semblable et, le cas échéant :
– s’il correspond à la description donnée par le vendeur et possède les qualités que celui-ci a présentées à l’acheteur sous forme d’échantillon ou de modèle ;
– s’il présente les qualités qu’un acheteur peut légitimement attendre eu égard aux déclarations publiques faites par le vendeur, par le producteur ou par son représentant, notamment dans la publicité ou l’étiquetage ;
2° Ou s’il présente les caractéristiques définies d’un commun accord par les parties ou est propre à tout usage spécial recherché par l’acheteur, porté à la connaissance du vendeur et que ce dernier a accepté.»
«Article L.217-12 du Code de la consommation :
L’action résultant du défaut de conformité se prescrit par deux ans à compter de la délivrance du bien.»
«Article 1641 du Code civil :
Le vendeur est tenu de la garantie à raison des défauts cachés de la chose vendue qui la rendent impropre à l’usage auquel on la destine, ou qui diminuent tellement cet usage, que l’acheteur ne l’aurait pas acquise, ou n’en aurait donné qu’un moindre prix, s’il les avait connus. »
«Article 1648 du Code civil, premier alinéa :
L’action résultant des vices rédhibitoires doit être intentée par l’acquéreur dans un délai de deux ans à compter de la découverte du vice.»
En cas de livraison au Client d’un Produit non-conforme à la commande ou révélant un vice caché, le Client pourra retourner le Produit ou contacter le Service Client via le formulaire de contact ou à l’adresse mail [email protected]
Le Client pourra bénéficier :
– soit d’un remboursement du prix du Produit commandé et des éventuels frais de livraison initiaux directement en magasin par crédit sur la carte bancaire, ou à distance, en réexpédiant son article par voie postale. Il appartient en tout état de cause au Client de se ménager la preuve de ce retour. A cet égard, le Client devra conserver la preuve de dépôt du colis qui lui sera remise par La Poste. En cas de perte du colis, aucun remboursement ne pourra être effectué sans cette preuve de dépôt.
7.3 Le droit de rétractation
Le Client dispose d’un délai légal de quatorze (14) jours calendaires après le jour où lui-même, ou un tiers autre que le transporteur, et désigné par lui, prend physiquement possession du dernier article de la commande, pour faire part au Vendeur de sa volonté de retourner un ou plusieurs articles sans avoir à justifier de motifs ni à payer de pénalités, à l’exception des frais de retour.
Pour exercer son droit de rétractation, le Client doit notifier au Vendeur sa décision de rétractation de la Commande au moyen d’une déclaration dénuée d’ambiguïté (lettre envoyée par la poste ou courrier électronique avec ses nom, prénom, adresse, téléphone, mail,… cf. modèle ci-dessous), avant l’expiration du délai de rétractation.

Le retour du Produit au Vendeur se fera directement par voie postale, comme indiqué à l’article 7.1 ci-dessus.
The Customer shall be refunded within 14 days from the date on which the Seller is informed of the Customer's decision to withdraw. The refund may be deferred until the Seller has recovered the products or until the Customer has provided proof of shipment of the products.
The refund will be made by crediting the Customer's bank account corresponding to the bank card used to pay for the order or by crediting the Customer's PayPal account if the order was paid for via PayPal.
7.4 Special cases of promotional offers:
All invoice discounts are broken down on each item in proportion to its price.
In the case of a promotional offer and a partial return of the order, the Customer will be reimbursed for the price of the item(s) returned, after deduction of the overall discount linked to the promotional offer applied to the total amount of the invoice, calculated in proportion to the price of the items returned.
7.5 The returned Product(s) must be new, unused, in their original box and original pouch.
Any item returned dirty and/or damaged and/or without their original box and/or pouch cannot be taken back. Upon receipt of the package, the Seller will judge the perfect condition of the returned Product(s). No return will be accepted if the returned Products have been visibly used or damaged by the Customer, such use or damage rendering the Products unfit for sale.
If the return is refused by the Seller, the Products will be returned to the Customer at the latter's expense without the latter being able to demand any compensation or right to reimbursement, with the exception of the subsequent exercise of his rights to a guarantee on the Products sold.
7.6 Error in the delivery address
The Customer is required to pay particular attention to the details filled in on the order form and in particular to the delivery address. If the Customer makes an error in the delivery address, the package will be returned by the carrier with the mention NPAI ("does not live at the address indicated"). In this case, the Customer will be reimbursed for the full amount of the order at the invoiced price excluding delivery. Delivery costs remain at the Customer's expense.

All the elements of the Site, whether visual or audio, including the underlying technology, are the exclusive property of the Seller and are protected by copyright as well as by the provisions relating to trademarks and/or patents.
The reproduction in whole or in part of any of these elements, on any medium whatsoever and for any reason whatsoever, without the prior and express consent of the Seller is strictly prohibited.
In the event of force majeure, as defined by the case law of the French courts, the performance of the Seller's services shall be suspended in whole or in part.
Force majeure is understood to mean any external, unforeseeable and insurmountable event that prevents the Seller from performing its contractual obligations.
In the event of the occurrence of an event qualified as force majeure in accordance with the previous paragraph, the Seller undertakes to notify the Customer as soon as possible.
Placing an order implies knowledge and acceptance of the characteristics and limits of the Internet. In particular with regard to technical performance, response times for consulting, querying or transferring information, the risks of interruption, and more generally, the risks inherent in any connection and transmission on the Internet, the lack of protection of certain data against possible hijacking and the risks of contamination by any viruses circulating on the Internet network.
Consequently, the Seller shall not, under any circumstances, be held responsible for any direct or indirect damage resulting from an interruption, a malfunction of any kind, or for any direct or indirect damage resulting in any way from a connection to the Site. It is the responsibility of any person connecting to the Site to take all appropriate measures to protect their own data and/or software stored on their computer equipment against any attack. The connection of any person to the Site is done under his or her own responsibility.
These General Terms and Conditions of Sale are applicable as long as they appear on the Site.
The Seller reserves the right to modify them at any time. In this case, the new modified General Terms and Conditions of Sale will only apply to orders placed after this modification.
These general terms and conditions of sale are governed by French law.
In the event of difficulty in the interpretation or execution of these terms and conditions, the Parties shall endeavour to resolve the dispute amicably.
Any dispute that may arise between the Parties as a result of the formation, interpretation and/or execution of these terms and conditions of sale shall, in the absence of an amicable settlement, fall within the exclusive jurisdiction of the French courts.
